1. general
- These General Terms and Conditions (hereinafter: "GTC") apply to the sale and delivery of the products listed on the dukaduka.ch website (hereinafter: "online store") to customers in Switzerland.
Please read these terms and conditions carefully before ordering products from our website.
By ordering our products, you agree to the following terms and conditions.

2. capacity to act
- You confirm that at the time of ordering a product from our website you have the capacity to act within the meaning of Art. 13 of the Swiss Civil Code, i.e. you are at least 18 years old and capable of judgment.
3. purchase of goods, ordering process
- Your order of a product on this website is deemed to be an offer to purchase the product in accordance with these GTC.
- After you have placed an order, you will receive an e-mail from us to indicate receipt of your order. Please note that this does not mean that your order has been accepted by us. For our security and to prevent fraud, we reserve the right to request that you confirm your order before accepting it:
- confirm certain information about your order by telephone.
- send us proof of your identity (e.g. a copy of your ID).
If you do not provide the requested information within a reasonable period of time, we reserve the right to refuse your order and to refrain from concluding a contract.
- If the products ordered are not available, we will notify you by e-mail and you will have the choice of waiting until the item is available from stock or canceling the order.
- We will confirm acceptance of your order by sending you an order confirmation by e-mail. A binding contract between you and us is only concluded once our order confirmation has been sent.
- Only those products whose shipment we have confirmed in the order confirmation shall become the subject matter of the contract.
- The order confirmation states the estimated shipping date of the products sold.
4. purchase price, payment and retention of title

- The purchase price of a product corresponds to the respective information on this website, except in cases of obvious errors.
The prices quoted are without guarantee and subject to any unforeseeable price changes by suppliers. We therefore reserve the right to adjust prices in exceptional cases.
Payment is possible by invoice and with all major credit cards MasterCard, Visa Card, American Express and Twint.
The credit card account is debited when the order is completed.
We reserve the right to restrict the use of the above-mentioned payment methods to the use of one or more payment methods on an individual basis.
The purchase prices quoted include VAT at the current rate, but do not include shipping costs.
The shipping costs are shown separately. Before the customer places the order, the purchase price and the shipping costs incurred are shown separately and as a total price.
Shipping is carried out by Swiss Post. You can be sure that your items will arrive reliably and promptly. Partial deliveries are charged according to the actual postage costs.
We will send you your items postage free from an order value of CHF 75.00 (in Switzerland).
- If we are in an obvious error regarding the purchase price that is recognizable by the customer, the contract is non-binding and we are not obliged to fulfill the contract. This applies regardless of whether the customer has already been sent an order confirmation with an incorrect purchase price.
- Payment can be made using the payment methods mentioned in the order process. The amount to be paid by the customer for the purchase price and shipping is listed in the order confirmation.
Payment must be received by us before the products are dispatched. The purchased products will only be dispatched once payment has been received.
- All credit card holders are subject to validity checks and approvals by the card issuer. We may exchange personal data of the credit card holder, which is necessary for these checks, with third parties. If the issuer of the credit card refuses to authorize payment to us, we are not liable for delays or non-deliveries.
- The shipped goods remain the property of Aare Gastro Service GmbH, Frikartstrasse 5, 4800 Zofingen until full payment has been received. There is no retention of title as long as the goods have not been paid for in full.
5. shipping

- We will inform you of the dispatch date by means of a dispatch note. Shipment will generally take place within 5 days of the date of the order, unless expressly agreed otherwise at the time the order is placed.
- The shipping address is as stated in the order confirmation, unless the customer has specified otherwise. For shipping reasons, products from one order may be split into several shipments.
- If we are unable to meet the estimated dispatch date stated in the order confirmation, the goods are not in stock and the new dispatch date is no longer within a period of 30 days from the order date, we will contact you immediately to inform you of the new dispatch date.
If you reject the new shipping date and we are unable to deliver the product(s) within 30 days of the original date of your order or before the specific delivery date agreed, if applicable, you may cancel the order at no cost and receive a full refund of the purchase price paid.
If several products are delivered in partial shipments, these partial shipments will be dispatched within 30 days of the order being placed, unless expressly agreed otherwise at the time the order is placed.
The delivery of other items is not affected by this. If you order several items with different delivery times, we will automatically deliver the products that are already available in advance.
6. transfer of risk
- The risk for the product is transferred to you upon dispatch. For the purposes of this provision, risk means financial responsibility for damage caused to the product through its use, handling, transportation or storage.
7 Right of withdrawal, consequences of withdrawal and returns
In the event of manufacturing errors and incorrect deliveries, we will exchange the items in question for a correct copy. To ensure that this service is available to everyone and to prevent misuse, the person returning the item (you) will bear the postage costs.

- Goods manufactured according to the customer's specifications.
- Goods that have been specially procured for the customer.
- In the event of an effective withdrawal, we will refund the price paid, provided the goods arrive unused and in their original condition.
- When returning goods, please always state the customer number and invoice number.
- The return shipment is at your own liability/risk.
The costs of the return shipment shall be borne by the revoking customer.
- Transport damage must be reported immediately by the customer to the local post office.
- The entire shipment including packaging must be presented to Swiss Post.
8. liability
- Claims by the customer for damages are excluded.
- Except for the statutory warranty for defects in the product sold, we do not warrant the performance or suitability for any use of any products or services offered on this website.
- We accept no liability for any errors in images or spelling on this website.
- We accept no liability for loss or damage of any kind arising out of or in connection with access to, use, performance, retrieval or downloading of data or files from this website or links to other websites.
- We assume no responsibility and give no guarantee that the functions, content, downloadable files and software on this website will be error-free or uninterrupted, that errors will be corrected or that this website or the servers are free of harmful components. Access to our website may be interrupted or impossible at any time, in particular during maintenance and improvement work on the website.
8. other
- Severability clause: Should one of the provisions of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.
- Electronic communication: If you use our website, you agree that communication with us - as far as legally permissible - will be by electronic means. We will contact you by e-mail at the e-mail address you have provided or write to you by post at the address you have provided.
- Should one or more provisions of these GTC be invalid, this shall not result in the invalidity of the entire contract. The invalid provision shall be replaced by the relevant statutory provision.
9 Applicable law and place of jurisdiction
- These GTC are subject to Swiss substantive law. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.
- The exclusive place of jurisdiction for all disputes arising from these GTC is Aargau, Switzerland. Duka Duka Denizel Larsen is also entitled to take legal action at the customer's domicile.
10. data protection
- In order to process orders, we store personal customer data in accordance with the applicable data protection provisions of Swiss law. We reserve the right to use this data to verify the shipping address and for credit checks. No data is transmitted to third parties and stored there, with the exception of the payment service providers required for validation.
